Laws for Divorce in India

Divorce Under the Hindu Marriage Act, 1955

As per Section 13 of the Hindu Marriage Act, the following are valid grounds for divorce:

Adultery — a valid ground for divorce, though no longer a criminal offense per recent Supreme Court judgment

Desertion — abandonment of a spouse by another

Insanity — permanent mental illness of one spouse

Conversion — change of religion without spousal consent

Renunciation — complete renunciation of family life

Cruelty — both mental and physical cruelty are recognised grounds

Presumption of death — no contact for over 7 years

Venereal disease — as an additional recognised ground

Divorce Under the Dissolution of Muslim Marriage Act, 1939

Muslim marriages function more as a contract than a sacrament, and the governing law differs accordingly. Grounds available include the husband's whereabouts being unknown for 4 years, failure to provide maintenance for 2 years, imprisonment of 7+ years, marriage before the age of 15, or subjection to mental or physical injury.
